Hi Dan,

I prepared the attached FAQ document to address the questions you have asked regarding ODOT requirements for right of way and frontage improvements that addresses your questions. The short answer is that ODOT does not have the authority to make requirements other than related to access to State highways OAR 734 Division 51. Since the city has a recent TSP, we typically look to Gerald to identify how much additional right of way is going to be required by the city to implement the TSP. It is also the city’s responsibility to determine whether frontage improvements will be triggered by the development.

The property currently has open frontage along the highway with front in parking near the property line. If the city requires frontage improvements and/or right of way donation it could impact the parking area. I will be checking in with Marcela to see whether what they are proposing will trigger a review of the highway access.

So far, it looks like my schedule has freed up quite a bit this week. If the city is going to be requiring frontage improvements and/or right of way donation along the highway, I think it would be helpful if we coordinated on this one before ODOT sends review comments. Let me know how you would like to proceed.

Hi Marah,

The attached proposal is for a single mobile food unit to be located at 102 Leroy Avenue in Molalla. The site is the existing location of Fred’s Food-O-Mart. The cart would be established as an accessory use.

City Code for single or double mobile food units dictates the following:

(6) Where frontage improvements would be triggered by development, the applicant may record a city approved non-remonstrance agreement in lieu of improvements; and

(7) Where insufficient right-of-way exists on a street abutting the property, dedication in accordance with the City of Molalla Transportation System Plan will be required.

Our main question are what ODOT would require for dedication and frontage improvements for this project.
