This rulemaking would maintain "identicality" by adding these new provisions to Oregon's LEV and ZEV regulations. California is the only state allowed to adopt vehicle emission standards under the Clean Air Act. However, once CA adopts their standards other states may adopt the same standards if they are identical to CA's rules. Oregon periodically incorporates CA's latest provisions into our program and such an update is due. Taking this action now to make our rules identical will position us well for the upcoming formal reevaluation of the LEV ZEV programs. Beginning in 2017, CA, EPA and USDOT will conduct a comprehensive Mid-Term Review of vehicle emission limits and fuel economy standards. The auto industry is expected to press for substantial relaxation of the rules in state and federal forums during this process. By updating Oregon's LEV and ZEV rules to match CA's at the beginning of this review period we will strengthen our ability to maintain strong LEV - ZEV requirements. California amends their vehicle emission standards almost constantly. OR's rulemaking process requires a significant amount of effort so Oregon (and other ZEV states) usually adopt only the most important rule changes as quickly as possible. OR could continue to delay adopting CA's most recent rule changes but we now have a backlog of four CA LEV-ZEV rulemakings comprising more than a dozen significant rule changes.
