The 2017 rulemaking will provide staff and stakeholders an opportunity to evaluate, improve and clarify the rule requirements necessary for implementation, compliance, and enforcement.

The driver rating would be elevated to “10” should this rulemaking be required to include a response to any legislation from the 2017 Legislative Session. This rulemaking may need to address potential legislation related to asbestos introduced in the 2017 Legislative Session While there is not an immediate urgency, rulemaking activities including advisory committee participation and input from DEQ technical staff are planned for 2017. Coordination with the advisory committee and statewide DEQ offices may take several months and include more than one meeting within the next six months. This rulemaking may also need to address any legislation related to asbestos passed in the 2017 Legislative Session. The next 12 months are important to meet our commitments to stakeholders, to the advisory committee and to DEQ technical staff, and to complete the rulemaking process prior to the planned presentation to the EQC in early 2018, as well as address any potential legislation from the 2017 Legislative Session. This rulemaking, in part, responds to inquiries that were brought up during the SB 705 rulemaking and improvements to reduce the release of asbestos into the environment when milling, manufacturing, fabricating, abatement, disposal or any situation where a potential for exposure to asbestos fibers exists.
