Particulate Emission Limitations for Sources Other Than Fuel Burning Equipment, Refuse Burning Equipment, and Fugitive Emissions

(1) no person may cause, suffer, allow, or permit particulate matter emission from any air contaminant source in excess of:

(a) For sources installed, constructed, or modified before June 1, 1970:

(A) 0.2 grains per dry standard cubic foot through December 31, 2015;

(B) 0.20 grains per dry standard cubic foot from January 1, 2016 through December 31, 2018; or

(C) 0.15 grains per dry standard cubic foot or install new or upgraded multiclone dust collector equipment or equivalent after January 1, 2018.

(D) The owner or operator of a source that must install a control device or modify an existing control device to meet the standard in paragraphs (B) or (C), may request that DEQ grant an extension allowing the source up to two additional years to comply with the standard, provided that the owner or operator submits an engineering report signed by a registered professional engineer that demonstrates that the source cannot comply with the standard without making significant changes to the equipment or control devices or adding control devices. The request for an extension must be submitted no later than 90 days prior to the compliance dates.

(b) For sources installed, constructed, or modified on or after June 1, 1970:

(A) 0.1 grains per dry standard cubic foot through December 31, 2015;

(B) 0.10 grains per dry standard cubic foot after January 1, 2018;

(C) The owner or operator of a source that must install a control device or modify an existing control device to meet the standard in paragraph (B), may request that DEQ grant an extension allowing the source up to two additional years to comply with the standard, provided that the owner or operator submits an engineering report signed by a registered professional engineer that demonstrates that the source cannot comply with the standard without making significant changes to the equipment or control devices or adding control devices. The request for an extension must be submitted no later than 90 days prior to the compliance dates.

(c) For sources installed, constructed or modified after March 31, 2014, 0.10 grains per dry standard cubic foot.

(d) If the owner or operator of a source installed, constructed or modified before March 31, 2014 is unable to comply with any of the compliance dates specified in paragraphs (a)(C) or (b)(B) and can demonstrate to DEQ’s satisfaction that the only way to meet those standards is by replacing the boiler, the owner or operator may request an alternative limit not to exceed 0.15 gr/dscf. The demonstration must be submitted by January 1, 2020 and must include the following:

(A) A control technology analysis signed by a registered professional engineer that includes the following:

(i) Identification of all available and technically feasible retrofit control technologies, including upgrades to existing control devices;

(ii) Evaluation of the control effectiveness of the control technologies identified in (i); (iii) Evaluation of the cost of the control technologies identified in (i), including the capital cost to purchase and install the equipment amortized over the remaining useful life of the emissions unit (not to exceed 30 years) plus the annual operating cost;

(iv) Evaluation of the environmental impacts of the control technologies identified in (i)

(v) Evaluation of the energy impacts of the control technologies identified in (i); and

(vi) Documentation of the results of the analysis demonstrating that add-on controls necessary to meet a limit of 0.10 gr/dscf are not reasonable for the affected emissions unit;

(B) Results of a source test performed after January 1, 2019; and

(C) A PM2.5 air quality impact analysis showing that the boiler emissions plus background will not exceed 30 ug/m3 on a 24-hour basis, using the following information:

(i) At least one year of ambient PM2.5 and meteorological monitoring data collected in accordance with a plan approved by DEQ prior to conducting the monitoring; or

(ii) Representative or conservative background data, if available and approved by DEQ.
