Grain Loading Standards

(1) No person may cause, suffer, allow, or permit particulate matter emission from any fuel burning equipment in excess of:

(a) For sources installed, constructed, or modified before June 1, 1970:

(A) 0.2 grains per dry standard cubic foot through March 31, 2015;

(B) 0.20 grains per dry standard cubic foot from April 1, 2015 through March 31, 2019.

(b) For sources installed, constructed, or modified on or after June 1, 1970:

(A) 0.1 grains per dry standard cubic foot through March 31, 2019 if located more than 5 miles of a PM10/PM2.5 sustainment area, nonattainment area, reattainment area, or maintenance area;

(B) 0.1 grains per dry standard cubic foot through March 31, 2015 if located within 5 miles of a PM10/PM2.5 sustainment area, nonattainment area, reattainment area, or maintenance area;

(C) 0.10 grains per dry standard cubic foot after March 31, 2015 if located within 5 miles of a PM10/PM2.5 sustainment area, nonattainment area, reattainment area, or maintenance area;

(d) For all sources, 0.10 grains per dry standard cubic foot after March 31, 2019.

(e) The owner or operator of any source installed, constructed or modified before April 1, 2014 who is unable to comply with any of the compliance dates specified in paragraphs (a)(B), (b)(C), and (d) above may request that DEQ grant an extension allowing the source up to one additional year to comply with the standard, provided that the owner or operator submits an engineering report signed by a registered professional engineer that demonstrates that the source cannot comply with the standard without making significant changes to the equipment or control equipment or adding control equipment. The request for an extension must be submitted no later than 90 days prior to the compliance dates.

(2) Compliance with the emissions standards in section (1) is determined using Oregon Method 5, or an alternative method approved by DEQ.

(a) For external combustion devices that burn wood fuel by itself or in combination with any other fuel, the emission results are corrected to 12% CO2.

(b) For external combustion devices that burn fuels other than wood, the emission results are corrected to 50% excess air.

(3) This rule does not apply to solid fuel burning devices that have been certified under OAR 340-262-0500.

OPTION 2

(1) No person may cause, suffer, allow, or permit particulate matter emission from any fuel burning equipment in excess of:

(a) For sources installed, constructed, or modified before June 1, 1970:

(A) 0.2 grains per dry standard cubic foot through December 31, 2014;

(B) 0.20 grains per dry standard cubic foot from January 1, 2015 through December 31, 2019; and

(D) The owner or operator of a source that must install a control device or modify an existing control device to meet the standard in paragraph (C), may request that DEQ grant an extension allowing the source up to two additional year to comply with the standard, provided that the owner or operator submits an engineering report signed by a registered professional engineer that demonstrates that the source cannot comply with the standard without making significant changes to the equipment or control devices or adding control devices. The request for an extension must be submitted no later than 90 days prior to the compliance dates.

(b) For sources installed, constructed, or modified on or after June 1, 1970:

(A) 0.1 grains per dry standard cubic foot through December 31, 2019;

(B) 0.10 grains per dry standard cubic foot after January 1, 2020;

(C) The owner or operator of a source that must install a control device or modify an existing control device to meet the standard in paragraph (B), may request that DEQ grant an extension allowing the source up to two additional year to comply with the standard, provided that the owner or operator submits an engineering report signed by a registered professional engineer that demonstrates that the source cannot comply with the standard without making significant changes to the equipment or control devices or adding control devices. The request for an extension must be submitted no later than 90 days prior to the compliance dates.

(d) If the owner or operator of a source installed, constructed or modified before March 31, 2014 is unable to comply with any of the compliance dates specified in paragraphs (a)(C) or (b)(B) and can demonstrate to DEQ’s satisfaction that the only way to meet those standards is by replacing the boiler, the owner or operator may request an alternative limit not to exceed 0.15 gr/dscf. The demonstration must be submitted by January 1, 2020 and must include the following:

(A) Identification of all available retrofit control technologies;

(B) Elimination of technically infeasible options;

(D) Evaluation of impacts and documentation of the results;

(E) Results of a source test performed after January 1, 2019;

(F) If representative or conservative background data is not available, at least one year of ambient monitoring, PM2.5 and meteorological data, at DEQ approved ambient monitoring site(s), gathered in accordance with a monitoring plan approved by DEQ for a minimum of one year ending no later than September 1, 2019;

(G) An air quality impact analysis showing that the boiler emissions plus background will not exceed 30 ug/m3 on a 24-hour basis.

(2) Compliance with the emissions standards in section (1) is determined using Oregon Method 5, or an alternative method approved by DEQ.

(a) For external combustion devices that burn wood fuel by itself or in combination with any other fuel, the emission results are corrected to 12% CO2.
