The Department recognizes that an unexpected or emergency condition exists at the listed facility. Based on the information contained in the application, the Department hereby authorizes certain activities, with restrictions, under the authority of ORS 468A.040 and OAR 340-216-0025(3).

Permitted Activities:

General Emission Standards:
5. Visible emissions from any equipment must not equal or exceed 20% opacity as a six-minute block average, excluding uncombined water vapor.
6. Particulate matter emissions from any source must not exceed 0.10 grains per standard cubic foot.
7. The permittee must take reasonable precautions to prevent fugitive dust emissions. The permittee must not cause or permit the emission of any particulate matter larger than 250 microns in size at sufficient duration or quantity, as to create an observable deposition upon the real property of another person.

Division 200: “Emergency” means any situation arising from sudden and reasonably unforeseeable events beyond the control of the owner or operator, including acts of God, which situation requires immediate corrective action to restore normal operation, and that causes the source to exceed a technology-based emission limitation under the permit, due to unavoidable increases in emissions attributable to the emergency. An emergency does not include noncompliance to the extent caused by improperly designed equipment, lack of preventative maintenance, careless or improper operation, or operator error.
