Maggie,

I accepted your changes to the Notice for LRAPA Open burning rules, with one exception based on input from legal counsel.

I didn’t add information about LRAPA’s advisory committee to any of the LRAPA notices. I asked Paul Garrahan about this before, and Paul agreed with AQ that we are not required to describe LRAPA’s advisory committee. EQC is reviewing DEQ’s rule for consistency with the CAA and state law. This is a not a case where the EQC is applying its own discretion and judgment regarding the LRAPA rules. If the public asks for LRAPA’s advisory committee information, we can provide it; however, since we think this rulemaking will receive very little interest from the public and EQC’s scope is limited, it would be a low-value use of time to add the information to DEQ’s notice.

I’ve completed my review, which included the OCO review, of the Invitation to Comment, Notice and rules are complete for the Open Burning rulemaking. Let me know if you have any questions.
