Yes, David should have Brian review it again to see if any amendments were made that would make it less stringent than our rules. Assuming that didn't happen, this should be pretty easy as discussed below.

 

It might be a good idea to write up a little procedure or check list on how to handle LRAPA rule adoptions so we don't need so many e-mails next time. I think the only time I need to review it is at the end, when the staff report for EQC adoption is being approved. I'll just be checking to make sure the staff report lays out the basic information (LRAPA amended their rules, state law requires LRAPA rules to be at least as stringent as EQC's, we reviewed and determined that they were, the amendments require a SIP revision meaning that EQC must adopt, we authorized LRAPA to act as hearings officer for the EQC for the SIP amendment, we reviewed the adopted rule and still find it to be at least as stringent as EQC's, we recommend EQC adopt as a SIP revision, next step is to submit to EPA).

We did review the rulemaking and we issued a letter authorizing LRAPA to serve as EQC Hearings Officer. The letter is dated July 20, 2007 and was signed by Margaret on behalf of Andy.

 

Andy, would you like someone to review the LRAPA's documentation one last time? If you do, I'll give the packet to David Collier to assign.

We had Brian Finneran review the rules prior to the public hearing. As for the permission to act as hearings officer and noticed as a SIP revision, I can't find the documentation on that. We will have to wait until Shelley returns from vacation.

If all went as normal, we would have given LRAPA permission to act as hearings officer for EQC, they would have noticed it as a SIP revision, and their hearing would have doubled for their adoption and EQC's approval into the SIP. If that happened, all we need is an adoption staff report, using the LRAPA rulemaking record as the attachments. Shelley would prepare it and shepard it though the process, and Merlyn or LRAPA staff might come up to the EQC meeting to help answer questions if needed.

I am almost certain that DEQ did review LRAPA's proposed open burning rules prior to public comment. LRAPA asked DEQ to co-sponsor the public hearing. Shelley and I will review when she returns. Larry

Normally, we do the review before the rules go out on public notic. So, maybe it has already been done. If not, we probably didn't authorize them to act as hearings officer for EQC, so we would have to renotice the rules. Can you find that out?

 

Typically, Brian Finneran would review, but he is overloaded with Regional Haze. So, I would give it to David Collier and have him assign it.

On March 14, 2008 the LRAPA Board of Directors adopted amendments to LRAPA Title 47, “Open Burning”. Merrie Dinteman of LRAPA has sent me the Staff Report, Hearings Officer’s Report, Affidavits of Publication of Notice, Draft Rules and various other documents pertaining to the adopted amendments.

 

LRAPA is requesting that DEQ’s AQ Division review these documents for consistency with Oregon’s SIP, seek approval of these actions by the EQC and, if approval is given, forward the rules to EPA for approval as an amendment to the SIP.

 

Margaret suggested I contact you for a recommendation on the staff person best suited to review these documents prior to your review.

 

I will be on vacation next week. I’ll leave the documents with Margaret. Thank you!
