Thanks Merrie,

The implementation plan looks solid. I haven't read thru the staff report yet. I appreciate your's and Ralph's effort in completing the staff report over the last two weeks. Especially now finding that your rules won't be going to EQC in October.

I will continue to work today to get an expected scenario and timeframe to you regarding your rules going to EQC if your Board decides to simply reauthorize taking these same rules back out to the public.

I am also writing a background summary of what has transpired over the last several months and why there is a need to re-notice these rules. My note will go to Andy Ginsburg and DOJ. I will send a copy to you to have on hand and share with Merlyn if you wish.

Larry and Shelley,

Here is the EQC staff report you requested. There are a couple of places where you’ll have to supply the Attachment designation. Also, I’m not very proficient at Word, so the spacing and indentations are a little funky. Also attached is the Rule Implementation Plan for the amended Title 47. The news releases indicated in the plan and in the body of the report can be located on LRAPA’s website in the box on the upper left that says “Press Releases” etc. If you click on the line at the bottom on that box, it will take to the archived press releases. There are two that pertain to open burning, dated March 21, 2008 and June 13, 2008.

I’ve sent you these just so you’ll have everything together for now. Merlyn is on vacation for most of the time until after Labor Day but will be in on Tuesday of next week. We have a public hearing on the permit streamlining rules that afternoon. (I don’t even want to THINK about THAT whole can of worms, yet. (There’s a really busy street right outside my office. The concept of running into traffic and spending the next few months in a coma is beginning to appeal to me.)

Merlyn will need to discuss with the board chair and vice-chair what direction they would like to go with the open burning rules—go with what’s already been adopted and just solicit public comment from both DEQ’s and LRAPA’s lists of interested persons, then re-notice and hold another hearing; or start over and make more changes before putting it out again and holding another hearing.
