Invitation to Comment – 2-page fact sheet

Proposed Rules – redline/strikethrough

Notice – information and analysis required by APA; Model Rules; DEQ statutes, rules and best practices; and federal regulations.

Proposal Minor changes to the clean diesel grant and loan rules to increase the types of activities eligible for grants. The proposed rules are identical to what EQC adopted in a temporary rulemaking in October 2013.

Need The Oregon Clean Diesel grant program promotes exhaust retrofits, nonroad engine repowers and truck scrapping to reduce diesel engine emissions. Federal grants allow for a broader range of activities, including idle reduction technologies and vehicle replacement, for funding under EPA program rules. SB 249, adopted by the 2013 Oregon legislature authorizes DEQ to apply for and administer federal grants under the comprehensive guidelines.

Affected parties Participation in the grant program is voluntary. Owners of diesel powered vehicles and equipment are affected by the rule in that they would be the sub-recipients of grant funds secured by DEQ for this purpose.

Public comment Starts Dec. 16, 2013 Ends Jan. 21, 2014

The rulemaking public notice packet is a major external deliverable in DEQ’s rulemaking process. On behalf of the rule design team, I thank all DEQ contributors to the notice packet.
