Hi Frank,
We notified AQ permit holders about the civil penalty rulemaking because AQ management asked us to. In addition, we notified everyone on DEQ’s subscription list. WQ or SW management did not ask us to notify their permit holders; however, any person interested in updates on DEQ rules, such as the contractors and permit holders who subscribe themselves to the list, received notification.

Andrea, I was looking at the email below addressing the Updating on Oregon Civil Penalty Rules. The email below states that Permit holders (AQ) were informed but are other folks like licensed asbestos abatement contractors or other licensed individuals or companies informed of these rule changes? What about the other programs like Water Quality and Solid Waste are their sources being informed of these changes.

Please forward this message to your permit staff since they might get calls from ACDP and Title V permit holders. DEQ is proposing a rulemaking to increase civil penalties. If adopted, permit holders who violate Oregon environmental regulations could see higher penalties. We emailed the below message to permit holders on August 15. DEQ’s office of compliance and enforcement mailed the rulemaking announcement to permit holders who do not have email addresses in TRAACS. As a person holding an AQ permit with DEQ or signed up for updates to the permitting program, you’re receiving this notification because DEQ is proposing updates to the Oregon Civil Penalty Rules. DEQ is proposing that the Environmental Quality Commission adopt rules to implement 2009 Oregon legislation that increased DEQ’s civil penalty statutory maximums. These amendments, if adopted, will be submitted to the U.S. Environmental Protection Agency for approval and as a revision to Oregon’s state implementation plan, a requirement of the Clean Air Act. The proposal affects businesses assessed a penalty for violating Oregon environmental regulations DEQ will hold a public hearing on Sept.17, 2013 at 2 p.m. in room EQC-A on the tenth floor at DEQ’s Headquarters Office, 811 SW 6th Ave., Portland, Or. Oral and written comments will be accepted at the hearing. For copies of the proposed rule package contact DEQ’s Office of Compliance and Enforcement located at 811 SW 6th Ave. in Portland, Ore. or call Jenny Root at 503-229-5874.
