RE: Permanent rule updates to Ambient Air Quality Standards for NO2, SO2 and Pb, and adoption of 1-hour Significant Impact Levels for NO2 and SO2
You hold an air quality permit with DEQ. This email is to inform you about proposed rule amendments that may affect your permitted activities. DEQ is developing a rulemaking proposal to update Oregon Administrative Rules as required by the Clean Air Act.
The Oregon Department of Environmental Quality’s (DEQ) Air Quality Division is accepting public comment on proposed permanent rule revisions to update ambient air quality standards to match federally-revised National Ambient Air Quality Standards for nitrogen dioxide, sulfur dioxide and lead and to adopt new, 1-hour Significant Air Quality Impact Levels for nitrogen dioxide and sulfur dioxide. The amendments, if adopted, will be submitted to the US Environmental Protection Agency for approval as revisions to the Oregon State Implementation Plan, as required by the Clean Air Act.
If the above proposed rule amendments are approved by the Environmental Quality Commission (EQC), DEQ will be require a demonstration that significant increases of NO2 and SO2 emissions do not cause or contribute to a violation of the 1-hour standards when an air quality impact analysis is required by either the Plant Site Emission Limit or Prevention of Significant Deterioration (PSD) programs. If an analysis is required, the analysis must be conducted in accordance with a modeling protocol approved by DEQ and the results must be included in the application for a new or modified permit.

Comments on this proposal can be presented at the hearing or mailed, faxed or e-mailed to DEQ during the public comment period. All comments must be received by 5:00 p.m. on August 19, 2013.
