A Conversion Technology Facility rulemaking meeting summary. Let me know if you have corrections/additions.
Need to update the SRP from 12/7/09. SRP says CT rulemaking will – define conversion technology facility, establish performance standards and permit requirements, and establish a fee schedule.
Need to make substantial progress (e.g., set up stakeholder meetings, draft rule language) by February 2012 – next legislative session.
List of issues – In scope or out-of-scope. If out of scope how will they be addressed – message map?
· As noted on SRP, need to define CTF, establish performance standards (compost rules as a go-by), and evaluate fees
· How CT fits with the waste management hierarchy (visioning process update)
· What is our authority for CT rulemaking – definition of solid waste and relevance of “fair market value”
· Recovery rate calculations
· Current per ton fees, wet vs dry, address energy potential

FYI - background:
· Draft IMD on CT disposal sites pre-dates our agreement to pursue rulemaking specific to CT facilities but provides technical detail
· Start Rulemaking Proposal to the EMT on 12/7/09
· March 2010 – Bob provided Jan with a draft definition for “Conversion Technology Facility”
"Conversion Technology" or "Conversion Technology Facility" means any method, technique, or process designed to change the physical, chemical, or biological character or composition of any solid waste and convert it to: 1) useful products and chemicals and/ or 2) directly to energy such as electricity generated from combustion of methane. It includes but is not limited to anaerobic digestion, esterification, gasification, hydrolysis, pyrolysis, thermal depolymerization and transesterification. It does not include "composting" as defined in section (18) of this rule, "material recovery" as defined in section (56) of this rule, nor does it apply to a "material recovery facility" as defined in section (57) of this rule.
