Subject: Agenda and proposed rules posted for Conversion Technology Aug 16 meeting

To the Conversion Technology Rulemaking Advisory Committee and interested parties:

As announced earlier, the next meet meeting of the Conversion Technology Advisory Committee will be August 16. DEQ has now posted the agenda, proposed draft rules (in 4 parts), and comments by committee member Joe Miller on issues related to Type 4 Feedstock and Bovine Spongiform Encephalopathy (BSE). Advisory Committee members: please look at these documents before coming to the meeting on August 16. There are a few places in these proposed rules where we have added notes highlighted in yellow to indicate that some information is missing or some provisions are not fully developed. We hope to complete work on those few items, and have it available by the August 16 meeting.

We had proposed having a special interim meeting to have a discussion as to when materials are regulated as solid waste, and when they are not. Because so many of the committee were interested in this issue, we decided to just discuss this issue at the August 16 advisory committee meeting instead. Gary Vrooman of the Oregon Department of Justice will present information on how DEQ interprets the statutory definition of solid waste, and what materials are or are not covered under that definition.

Because we will have a lot to cover in the August 16 meeting, we will need to move quickly through the subject matter. At the meeting, we will mainly be seeking input on the important issues for each of the elements of the proposed rules that we have not covered earlier. If you have suggestions for small wording changes that do not warrant discussion by the whole group, it would be helpful if you could submit those by email or in writing. This may potentially be the last meeting of the advisory committee. However, if we do not finish discussion on all the substantive issues at the August 16th meeting, or uncover further substantive issues that need more advisory committee discussion, then we may need to do a follow-up meeting.
