Hi Steve,

This is a nudge. Every month at this time, I complete an audit of our rulemaking record. The rulemaking record for the 401 rules that the EQC approved in October are missing

no one has requested that I file the 401 Fee Increase rules that went to the with the Secretary of State. There is no legal requirement for when we file them; however, if the fees required DAS approval before they become effective, we are required to submit the signed Fee Approval Form – Part 2 within 10 days of the EQC meeting. DAS notification that the EQC adopted the WQ Permit Fee Increase on Oct. 25, 2012. This fee was exempt from DAS approval under ORS 291.055(1)(a). This means we were not required to report the fee change to DAS within 10 days of adoption for the fee to become effective but DAS requires agencies “notify” them about all fee changes.
