Dear Title V permit holder:
DEQ is proposing a rulemaking to increase Oregon’s Title V operating permit fees as authorized in statute. The fee increase applies to permit fees that will be collected in 2012 and 2013.
The federal Clean Air Act requires that Oregon’s Title V program be fully funded by permit fees. Oregon law gives the Environmental Quality Commission authority to adjust all of the fee categories by the annual change in the consumer price index. DEQ must make these adjustments so that permit fees keep pace with inflation.
The proposed rulemaking would increase Title V fees for 2012 and 2013 by the changes in the 2011 and 2012 consumer price index, respectively. The 2011 increase is approximately 2.4 percent. The data needed to calculate the amount of the 2012 increase will be available in September 2012. DEQ expects it will be comparable to the 2011 increase. There are three types of fees: base fees, emission fees and specific activity fees. The table below lists the proposed base fees and emission fees.
Proposed Title V fees for 2012 and 2013 by fee category:
* DEQ has estimated the fees for the 2013 invoice year using the 2011 change in the consumer price index. The 2013 fees in the final rule will be based on the 2012 change in the consumer price index, which will be published by the federal government in September 2012. DEQ is also proposing increases to the specific activity fees based on the changes in the consumer price index. Please see the rulemaking announcement for details regarding the specific activity fees. The rulemaking documents are available on DEQ’s website: http://www.deq.state.or.us/regulations/proposedrules.htm. DEQ plans to recommend that the commission adopt the rules at two separate commission meetings taking place on June 21-22, 2012 for the 2012 fees, and Dec. 13-14, 2012 for the 2013 fees. If the commission adopts the proposed rules, the fee increases will be reflected in invoices to be issued in August 2012 and August 2013.
