Following response to comments on the proposed E-Cycles rules, here are the change we want to make and a couple changes we are considering in response to comments:

Change we want:

· Changes in -0150. Reduce the E-Cycles registration fee for the smallest manufacturers -- i.e., those making 50 or fewer units – to $40 vs. $200. You’ll see my questions and comments on the attached draft. The question is whether to add a tier 7 (for 50 or fewer units) or leave Tier 6 as is and specify the fee for Tier 6 as $200 for mfrs whose market share equates to more than 50 units and $40 for the others. See comments.

Considering – in response to comments:

· Adding statement in -0100(2) that DEQ will make good faith efforts to collect fees. See comment.

· Adding date in -0200(1) – when DEQ will notify mfrs of preliminary MS and fee determinations. See comment.

Will you be able to review the draft and get back to us by COB Tuesday, 5/8? As always, the sooner the better.
