At Tuesday's EMT discussion of the 2009-2010 Rules Agenda we discussed the Director's guidance about taking rulemakings out for public comment during a legislative session. That guidance was basically that DEQ will only do so when the rulemaking has full stakeholder support AND it is not a controversial rulemaking. Otherwise the public comment period should not be open during the session (I take that to be Jan through the end of June).
I recall during that discussion, you considered revising the timeframe of the PCTC rulemaking, but looking at the dates in the attached description, the schedule calls for it to go out for public comment in June. So a delay of one month would set this timeframe in good standing.
I actually think this rulemaking fits the criteria (full stakeholder support and not controversial), but it is your rulemaking. Let me know what dates you want to go with.
