Larry M., the attached draft language is what I sent to Larry K. I decided to go with a new section. This is still a simple rulemaking if Larry say’s the language is OK after he considers the following.

EQC authority to transfer tax credits and reissue certificates comes from ORS 315.304 under DOR administration not ORS 468. I think we are OK because in 1997-1998 there was some discussion about DOR rules authorizing transfers and reissues when the EQC adopt OAR 340-016-0080(4). Revocations are not an issue because the EQC has the authority to revoke certificates under ORS 468. This rulemaking delegates certificate revocations when the taxpayer notifies DEQ the facility is not longer in use; all other revocations would go to the EQC.
