Hi Lisa,

DEQ has two preliminary request in to DAS for fee review and hopefully approval.

-Air Quality’s Air Contamination Discharge Permit fees, DEQ submitted the preliminary request for review/approval in an email June 2 (see attached). I understand from talking with Greg A. the impact on small businesses due to new federal regulations and the expected ACDP rulemaking at DEQ were discussed at Ways and Means, but the actual fee amount associated with the rulemaking was not able to be defined at that time (I understand SB 103 now authorizes a new fee).

DEQ has not submitted a formal, hardcopy request for DAS review/approval and would like to do so. And we would like your preliminary response as well.

The timeframe for the associated rulemaking and DAS fee approval is getting tight. The ACDP rulemaking is scheduled to go out to public comment starting July 14 (being submitted to SOS Bulletin, with public notice starting around August 1). If it is your sense that DAS approval won’t happen by July 14, I would like to pass that on to DEQ management so a decision to go out to public notice can consider that info.

Are you able to provide any feedback based on the preliminary information? May DEQ submit the formal request for review/approval now? What is your expectation that this fee can be approved by DAS before 7/14?
