Be advised Sarah Armitage is doing a massive rulemaking that will also revise the State Implementation Plan (and therefore revise division 200). Sarah Armitage's rules are scheduled for the EQC in October, but she is discussing the possibility of moving that forward to August.

OCE's rule is not expected to go to EQC until October. So Dave should have free sailing with the existing versions of Div 200 regarding the SIP through both the EQC and SOS. OCE's rule will once again revise Div 200 once Dave gets through with it.
Sarah - The amendments you are proposing to Div 200 (out for public comment on June 1) are based on the current 4/12/07 version of OAR 340-200-0040. That makes sense. And Dave is going to mess up everything by revising the 4/12 version between the time you take it out for public comment and when your rule goes to EQC. Common sense would indicate you can only amend the current version. So you will be noticing amendments to the 4/12 version of Div 200, but by the time your rule is submitted to EQC, you will be asking the EQC to adopt amendments to the 6/30 version of Div 200.
I don't know that there is anything to be done about this. It would be good to make a note of this somewhere, but I don't know where that would be. It is not worth mentioning inside a notice document (like the rulemaking announcement) because it would just add to the confusion factor for the reader.

Be advised that OAR 340-200-0040 is currently being amended in tandem by DEQ’s department of enforcement.
Please check with Sarah to see when her EQC date is.
If you are both scheduled for the same EQC date, only one of you needs to include OAR 340-200-0040 with the date amendment.
If you have differing EQC dates, we will need to coordinate the availability of the latest version of OAR 340-200-0040 as this runs the risk of the SOS being behind by one version given they only post to the internet once-a-month.
