Subject:  EQC changes to your proposed rules

Hi Sarah,

I located the recording of your presentation at the EQC on October 17, 2007. I did listen to the entire discussion of your agenda item

Fortunately, the discussion was brief. There was no discussion by the EQC of making changes to the rule as your proposed them.

At one point Chairwoman Hampton said she had a concern that this new clarification process not be used as a tool to beat ALJs for requests for clarification and that she expected DEQ to monitor that these opportunities for clarification not be abused by the "other side" (meaning the regulated community) to make work for the ALJs or to slow down the process.

The Commission adopted your proposed rule amendments as presented in Attachment A.
