Memo
Attached is the draft
notice package of the proposed “Adoption of Federal Air Quality
Regulations”. Please provide any comments and send it back to me
electronically or in hard copy form by Friday, May 30, 2008. To expedite
the draft review, I’ve summarized the sections where you can focus your
attention.
- Paul Logan (DOJ): The rules adopt federal
rules by reference including several new area source NESHAPs, implement and go
beyond the Gasoline Dispensing NESHAP, defer the requirement that gasoline
dispensing facilities get an AQ permit, adopt standards that go beyond the
recently amended Emission Guidelines for Large Municipal Waste Combustors, and
adopt new General Permits to implement the new area source NESHAPs. I’d like you to concentrate your
efforts on reviewing the rule language.
Please make sure all legal issues are adequately resolved, and the
proposed rulemaking is legally sufficient (within authority, consistent with
statute, enforceable).

impact statement.

Coordinator): Please make sure the proposed rules are
consistent with other rules/statutes and meet standards for rule writing and
that the package is well written.

(DEQ Rule Coordinator): Please check that the package
meets the procedural requirements and is satisfactory for submittal to the
SOS.
