Draft Notice Package

 Attached is the draft notice package of the proposed “Adoption of Federal Air Quality Regulations”.  Please provide any comments and send it back to me electronically or in hard copy form by Friday, May 30, 2008.  To expedite the draft review, I’ve summarized the sections where you can focus your attention. 

 

  • Paul Logan (DOJ):  The rules adopt federal rules by reference including several new area source NESHAPs, implement and go beyond the Gasoline Dispensing NESHAP, defer the requirement that gasoline dispensing facilities get an AQ permit, adopt standards that go beyond the recently amended Emission Guidelines for Large Municipal Waste Combustors, and adopt new General Permits to implement the new area source NESHAPs.  I’d like you to concentrate your efforts on reviewing the rule language.  Please make sure all legal issues are adequately resolved, and the proposed rulemaking is legally sufficient (within authority, consistent with statute, enforceable).

 

  • Names of participating EMT members: 

·         Johnny Baumgartner/Cory Ann Wind/Nina DeConcini (NWR):  Please review the Gasoline Dispensing Rules and General Permits.

·         Mark Fisher/Linda Hayes-Gorman/Mitch Wolgamott (ER): Please review the Utility Mercury Rule amendments.

·         Wendy Wiles (LQ): Please review the Gasoline Dispensing Rules and permitting fees for gasoline stations.

·         Jane Hickman (OCE):  Please look at rules to ensure the enforcement issues are addressed. 

 

  • Jim Boylan/Cheryl Hutchens-Woods (WR):  Please review that Large MWC Rules.

 

  • Robin Williams (MSD):  Please review the fiscal and economic impact statement.

 

  • Shelley Matthews (AQ Rules Coordinator):  Please make sure the proposed rules are consistent with other rules/statutes and meet standards for rule writing and that the package is well written.

 

  • Larry McAllister (DEQ Rule Coordinator): Please check that the package meets the procedural requirements and is satisfactory for submittal to the SOS.

 

  • Sarah Armitage (AQ): Please review the Gasoline Dispensing Rules and General Permits.

 

  • Uri Papish (Lead Manager):

 

  • Acting Lead Administrator:   Please check that issues are adequately addressed, internal and external stakeholders have been adequately involved and the package meets quality standards.
